This document (together with the other documents referred to herein) governs the conditions applicable to the use of this Website (https://bateriasencasa.com) and to the purchase or acquisition of products and/or services on it (hereinafter, the Conditions).

For the purposes of these Conditions, the activity carried out by bateriasencasa.com through the Website is understood to comprise:

In addition to reading these Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice and the General Conditions of Use, including the cookie policy and the privacy and data protection policy of bateriasencasa.com. By using this Website or by placing and/or requesting an order for a product and/or service through it, the User agrees to be bound by these Conditions and by all of the foregoing; therefore, if the User does not agree with all of the above, they must not use this Website.

Furthermore, the User is informed that these Conditions may be amended. The User is responsible for consulting them each time they access, browse and/or use the Website, since the Conditions in force at the time the acquisition of products and/or services is requested will apply.

2. THE USER

Accessing, browsing and using the Website confers the status of user (hereinafter referred to, indistinctly, individually as the User or jointly as the Users), whereby all the Conditions set out herein, as well as any subsequent amendments thereto, are accepted from the moment browsing of the Website begins, without prejudice to the application of the corresponding mandatory legal regulations, as the case may be.

The User assumes responsibility for the correct use of the Website. This responsibility shall extend to:

• Using this Website solely to make legally valid enquiries and purchases or acquisitions.
• Not making any false or fraudulent purchase. If it could reasonably be considered that a purchase of this kind has been made, it may be cancelled and the relevant authorities would be informed.
• Providing truthful and lawful contact details, for example, email address, postal address and/or other details (see the Legal Notice and General Conditions of Use).

The User declares that they are over 18 years of age and have the legal capacity to enter into contracts through this Website.

The Website is aimed mainly at Users resident in Spain. bateriasencasa.com does not ensure that the Website complies, in whole or in part, with the legislation of other countries. bateriasencasa.com disclaims all liability that may arise from such access, nor does it guarantee shipments or the provision of services outside Spain.

The User may, at their choice, enter into the contract of sale of the desired products and/or services with bateriasencasa.com in any of the languages in which these Conditions are available on this Website.

3. PURCHASE OR ACQUISITION PROCESS

Users may purchase on the Website by the means and in the manner established. They must follow the online purchase and/or acquisition procedure of https://bateriasencasa.com, during which various products and/or services may be selected and added to the cart, basket or final purchase area and, finally, click to purchase the product.

The User must also fill in and/or check the information requested at each step, although, during the purchase process and before making payment, the purchase details may be modified.

The User will then receive an email confirming that bateriasencasa.com has received their order or request for purchase and/or provision of the service, i.e. the order confirmation. Where applicable, the User will also be informed by email when their purchase is being shipped. Where applicable, this information may also be made available to the User through their personal account area on the Website.

Once the purchase procedure has been completed, the User consents to the Website generating an electronic invoice, which will be sent to the User by email and, where applicable, through their personal account area on the Website. The User may also, if they so wish, obtain a paper copy of their invoice by requesting it from bateriasencasa.com using the contact areas of the Website or the contact details provided above.

The User acknowledges being aware, at the time of purchase, of certain particular conditions of sale concerning the product and/or service in question, which are displayed alongside its presentation or, where applicable, its image on its page of the Website, indicating, by way of example but not limitation, and as appropriate in each case: name, price, components, weight, quantity, colour, product details or characteristics, the manner in which the services will be performed and/or their cost; and acknowledges that placing the purchase or acquisition order constitutes full and complete acceptance of the particular conditions of sale applicable in each case.

Unless expressly stated otherwise, bateriasencasa.com is not the manufacturer of the products sold or which may be marketed on the Website. Although bateriasencasa.com makes great efforts to ensure that the information displayed on the Website is correct, the packaging and/or materials and/or components of the products may occasionally contain additional or different information from that shown on the Website. The User should therefore consider not only the information provided by the Website, but also the information available on the labelling, warnings and/or instructions accompanying the product.

4. AVAILABILITY

All purchase orders received by bateriasencasa.com through the Website are subject to the availability of the products and/or to no circumstance or cause of force majeure (clause nine of these Conditions) affecting their supply and/or the provision of the services. Should difficulties arise regarding the supply of products or should products be out of stock, bateriasencasa.com undertakes to contact the User and refund any amount that may have been paid. This shall also apply in cases where the provision of a service becomes impossible. Under no circumstances shall an amount greater than that paid by the customer be refunded.

5. PRICES AND PAYMENT

The prices displayed on the Website are final prices, in Euros (€), and include taxes, unless a different treatment is indicated and applied owing to legal requirements, particularly with regard to VAT (IVA).

However, unless otherwise indicated on a specific occasion, the prices of the items offered exclude any shipping costs that may be incurred, which will be added to the total amount due when the User manages the shipping procedure, at which point the User will consult the available shipping methods and costs and freely choose the one that best suits them.

Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.

Prices may change at any time but, except in the event of a pricing error, any changes will not affect orders or purchases in respect of which the User has already received an order confirmation and the product was available in our warehouses at the time the order was placed.

The accepted means of payment are: Credit or debit card, PayPal, Bank transfer, Bizum and Cash on delivery

bateriasencasa.com uses all means to guarantee the confidentiality and security of the payment data transmitted by the User during transactions through the Website. As such, the Website uses an SSL (Secure Socket Layer) secure payment system.

Credit cards will be subject to checks and authorisation by the issuing bank; if that bank does not authorise the payment, bateriasencasa.com will not be liable for any delay or failure to deliver and will be unable to enter into any contract with the User.

Once bateriasencasa.com receives the User's purchase order through the Website, a pre-authorisation will be made on the relevant card to ensure that sufficient funds are available to complete the transaction. The card will be charged at the time the shipping confirmation and/or confirmation of the service to be provided in the established manner and, where applicable, place is sent to the User.

If the means of payment is PayPal, the charge will be made at the time bateriasencasa.com sends the User a confirmation of the order for the purchase or acquisition of products and/or services.

In any event, by making the purchase, the User confirms that the payment method used is their own.

Purchase or acquisition orders for which the User selects bank transfer as the means of payment will be reserved for 5 calendar days from the order confirmation, in order to allow sufficient time for the bank transfer to be registered by the payment system used by bateriasencasa.com for the Website. When the system receives the full amount of the order in the account, after deduction of any bank charges for receiving the transfer, the order will be prepared and processed for shipment.

With this payment method, the User must ensure that they correctly enter the exact amount of the purchase order, as well as the account number and the transfer reference. In the event of an error in those details or if the correct amount is not received, bateriasencasa.com will be unable to validate the order, which will be cancelled and the full amount received will be refunded, after deduction of any charges for issuing the transfer.

For cash on delivery payment, the User must select "Cash on delivery" among the payment methods on the Website and continue until the purchase order is placed. From that moment, bateriasencasa.com reserves the right to contact the User in order to validate the purchase order with them. After this, the order will be prepared and made available for shipment.

Payment will be made at the time the order is delivered by the carrier's courier. Payment may be made in cash only. The User undertakes to hand the carrier's courier the exact amount of the order, as the courier will be unable to provide change.

For the refund of the amount of orders paid by cash on delivery, bateriasencasa.com reserves a period of 14 calendar days after the return has been requested through the Website and the parcel has been handed back to the carrier. When making the return, the User must provide their bank details in order to receive the transfer corresponding to the requested refund of the amount of the returned order. Refunds of orders paid by cash on delivery will be made by bank transfer only, and any payment charge for issuing the transfer, if applicable, will be deducted.

bateriasencasa.com reserves the right to withdraw cash on delivery payment from Users who have not complied with the necessary requirements on past orders.

6. DELIVERY

Except in cases where there are unforeseen or extraordinary circumstances, such as stock shortages or, where applicable, circumstances arising from the personalisation of products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on the Website according to the shipping method selected by the User and, in any event, within a maximum period of 30 calendar days from the date of the order confirmation (unless an extraordinary delivery date accepted by the user is notified).

However, it should be borne in mind that orders will be shipped on working days that are not also public holidays in the locality from which the products are shipped. This may cause delays with respect to the specified delivery period.

If, for any reason attributable to the company and not to the transport company, bateriasencasa.com is unable to meet the delivery date, it will contact the User to inform them of this circumstance, and the User may choose either to proceed with the purchase by setting a new delivery date or to cancel the order with a full refund of the price paid. In any event, home deliveries are made on working days.

If it proves impossible to deliver the order owing to the User's absence, the order may be returned to the warehouse. However, the carrier would leave a notice explaining where the order is and how to arrange for it to be delivered again.

If the User will not be at the place of delivery during the agreed time slot, they must contact bateriasencasa.com or the courier company directly to arrange delivery on another day.

If 30 days elapse from the time the order is available for delivery and it has not been delivered for reasons not attributable to bateriasencasa.com, bateriasencasa.com will understand that the User wishes to withdraw from the contract and the contract will be deemed terminated. As a consequence of the termination of the contract, all payments received from the User will be refunded, with the exception of any additional costs resulting from the User's own choice of a delivery method other than the least expensive standard delivery method offered by the Website, without undue delay and, in any event, within a maximum period of 14 calendar days from the date on which the contract is deemed terminated.

However, the User should bear in mind that the transport arising from the termination may entail an additional cost that may be passed on to them.

For the purposes of these Conditions, delivery shall be deemed to have taken place, or the order to have been delivered, at the time the User or a third party designated by the User acquires physical possession of the products, which shall be evidenced by signing for receipt of the order at the agreed delivery address.

The risks that may arise from the products shall be borne by the User from the time of delivery. The User acquires ownership of the products when bateriasencasa.com receives full payment of all amounts due in relation to the purchase or acquisition made, including shipping costs, or at the time of delivery, if this takes place after bateriasencasa.com has received the full amount payable.

The applicable VAT (IVA) rate shall be that legally in force at any given time depending on the specific item concerned and its destination.

Should the purchased product be unavailable, the company may replace it with another product of the same dimensions and characteristics but of higher performance.

All goods must be checked before acceptance and, should they show any kind of breakage, this must be recorded on the carrier's delivery note. No claim for breakage in transit will be accepted once 24 hours have elapsed since receipt.

7. TECHNICAL MEANS FOR CORRECTING ERRORS

The User is hereby informed that, should they detect that an error has occurred when entering the data necessary to process their purchase request on the Website, they may modify such data by contacting bateriasencasa.com through the contact areas enabled on the Website and, where applicable, through those enabled for contacting the customer service department, and/or using the contact details provided in clause one (General information). This information may also be corrected by the User through their personal account area on the Website.

In any event, before clicking on "Place order", the User has access to the area, cart or basket where their purchase requests are recorded and may make modifications.

Likewise, the User is referred to the Legal Notice and General Conditions of Use and, in particular, the Privacy Policy for further information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, GDPR (RGPD), and in Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights).

8. RETURNS

Where the User acquires products on or through the owner's Website, they are entitled to a series of rights, as listed and described below:

Right of Withdrawal

The User, as a consumer and user, makes a purchase on the Website and is therefore entitled to withdraw from that purchase within 14 calendar days without giving any reason.

This withdrawal period will expire 14 calendar days from the day on which the User, or a third party authorised by the User other than the carrier, acquired physical possession of the goods purchased on the bateriasencasa.com Website or, if the goods making up the order are delivered separately, 14 calendar days from the day on which the User, or a third party authorised by the User other than the carrier, acquired physical possession of the last of the goods making up the same purchase order or, in the case of a service contract, 14 calendar days from the day on which the contract was concluded.

To exercise this right of withdrawal, the User must notify their decision to bateriasencasa.com. They may do so, where applicable, through the contact areas enabled on the Website.

Regardless of the means chosen to communicate their decision, the User must clearly and unequivocally state their intention to withdraw from the purchase contract. In any event, the User may use the model withdrawal form that bateriasencasa.com makes available as an annex to these Conditions; however, its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication unequivocally expressing the decision to withdraw to be sent before the relevant period expires.

In the event of withdrawal, bateriasencasa.com will refund to the User all payments for the product without undue delay and, in any event, no later than 14 calendar days from the date on which bateriasencasa.com is informed of the User's decision to withdraw.

bateriasencasa.com will refund the User using the same payment method used by the User for the initial purchase transaction. This refund will not incur any additional cost for the User. However, bateriasencasa.com may withhold the refund until it has received the products or items purchased and verified that they have been received in perfect condition.

The User may return or send the products to bateriasencasa.com at: C/ Croacia, 6, 29004 Málaga (Spain).

And must do so without undue delay and, in any event, no later than 14 calendar days from the date on which bateriasencasa.com was informed of the decision to withdraw.

The User acknowledges that they must bear the direct cost of returning the goods (transport, delivery), if any is incurred. In addition, the User will be liable for any diminished value of the products resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

However, under the company's returns policy set out in the "Shipping and Returns" section, there are cases in which the company will collect the products that the user wishes to return. Essentially, this applies to items sent to the Spanish mainland by standard, non-industrial parcel companies that we had in stock at the time the order was placed. In these cases, the company will collect the item at no cost to the customer. Once the order arrives at our premises and the correct condition of the returned items has been verified, the amount paid for the product will be refunded.

The User acknowledges being aware that there are exceptions to the right of withdrawal, as set out in Article 103 of Real Decreto Legislativo 1/2007, de 16 de noviembre (Spanish Royal Legislative Decree 1/2007 of 16 November), approving the consolidated text of the Ley General para la Defensa de los Consumidores y Usuarios (General Law for the Protection of Consumers and Users) and other complementary laws. By way of example but not limitation, this would be the case for: personalised products; products that are liable to deteriorate or expire rapidly; music or video CDs/DVDs without their packaging as sealed at the factory; products which are sealed for reasons of hygiene or health protection and have been unsealed after delivery.

The provision of a service that the User may contract on this Website is governed in the same way, since the same Law establishes that Users shall not have the right of withdrawal once the service has been fully performed or, where performance has begun, with the express consent of the consumer and user and with their acknowledgement that they are aware that, once the contract has been fully performed by bateriasencasa.com, they will have lost their right of withdrawal.

In any event, no refund will be made if the product has been used beyond merely opening it, for products that are not in the same condition in which they were delivered, or for products that have suffered any damage after delivery.

The products must also be returned using or including all their original packaging, the instructions and any other documents that may accompany them, together with a copy of the purchase invoice.

These conditions apply only to relations between consumers or users and traders as defined in Article 3 of Real Decreto Legislativo 1/2007 approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws. They therefore do not apply to commercial relations with legal entities acting for profit, and in particular do not apply in cases where an order has been placed for products that are not available at the time of purchase and have been expressly ordered from a third party.

Return of defective products or shipping errors

This covers all cases in which the User considers that, at the time of delivery, the product does not conform to the provisions of the contract or purchase order and must therefore contact bateriasencasa.com immediately to inform it of the existing lack of conformity (defect/error) by the same means or using the contact details provided in the previous section (Right of Withdrawal).

The User will then be informed of how to proceed with the return of the products and, once returned, the products will be examined and the User will be informed, within a reasonable period, whether a refund or, where applicable, a replacement is appropriate. Should it be determined that there is no lack of conformity, neither a refund nor a replacement of the product will be made and the User must bear all costs arising from the inspection and possible return of the product.

The refund or replacement of the product will be made as soon as possible and, in any event, within 14 days of the date on which we send an email confirming that the refund or replacement of the non-conforming item is to proceed.

The amount paid for products returned owing to a defect, where one genuinely exists, will be refunded in full. The refund will be made using the same means of payment that the User used to pay for the purchase.

In any event, the rights granted to the User under the legislation in force at any given time shall always prevail.

Guarantees

The User, as a consumer and user, enjoys guarantees on the products they may acquire through this Website, under the terms legally established for each type of product; bateriasencasa.com is therefore liable for any lack of conformity of the products existing at the time of purchase which becomes apparent within two years of delivery of the product.

In this respect, products are deemed to be in conformity with the contract provided that they:

- Comply with the description given by bateriasencasa.com and possess the qualities presented in it

- Are fit for the purposes for which products of the same type are ordinarily used. This includes the expected service life of the product according to its use.

- Show the quality and performance that are normal in a product of the same type and that can reasonably be expected of it.

Where this is not the case with regard to the products delivered to the User, the User must proceed as indicated in the section Return of defective products or shipping errors. However, some of the products marketed on the Website may present non-uniform characteristics, provided that these derive from the type of material from which they have been manufactured; such characteristics will therefore form part of the individual appearance of the product and will not be a defect.

In the specific case of batteries, it is stated that discharging a battery and keeping it below 12.4 volts initiates a sulphation process that impairs its performance, and such impairment cannot be considered to have been caused by a manufacturing defect in the product. Consequently, claims will not be accepted for batteries that have been kept discharged or that arrive at our premises below 12 volts.

9. EXCLUSION OF LIABILITY

Unless otherwise provided by law, bateriasencasa.com shall not accept any liability for the following losses, regardless of their origin:

• any losses that are not attributable to any breach on its part;
• business losses (including loss of profits, revenue, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred); or
• any other indirect loss that was not reasonably foreseeable by both parties at the time the contract of sale of the products was concluded between them.

Likewise, bateriasencasa.com also limits its liability in the following cases:

• bateriasencasa.com applies all measures to provide an accurate display of the product on the Website; however, it is not liable for minor differences or inaccuracies that may exist owing to a lack of screen resolution, problems with the browser used or other issues of this kind.
• bateriasencasa.com will act with the utmost diligence in making the product covered by the purchase order available to the company responsible for its transport. However, it is not liable for damage arising from a malfunction of the transport service, especially for causes such as strikes, road hold-ups and, in general, any others inherent to the sector, which result in delays, loss or theft of the product.
• Technical failures which, owing to fortuitous or other causes, prevent the normal operation of the service via the Internet. Lack of availability of the Website for maintenance or other reasons, preventing use of the service. bateriasencasa.com makes every means at its disposal available to carry out the process of purchase, payment and shipment/delivery of the products; however, it is exempt from liability for causes not attributable to it, fortuitous events or force majeure.
• bateriasencasa.com shall not be liable for the misuse and/or wear and tear of products that have been used by the User. At the same time, bateriasencasa.com shall not be liable for an incorrect return made by the User. It is the User's responsibility to return the correct product.
• In general, bateriasencasa.com shall not be liable for any failure or delay in the performance of any of the obligations assumed, where this is due to events beyond its reasonable control, i.e. due to force majeure, which may include, by way of example but not limitation:
  • Strikes, lockouts or other industrial action.
  • Civil commotion, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat of or preparations for war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
  • Inability to use trains, ships, aircraft, motor transport or other means of transport, whether public or private.
  • Inability to use public or private telecommunications systems.
  • Acts, decrees, legislation, regulations or restrictions of any government or public authority.

Accordingly, the obligations shall be suspended for as long as the cause of force majeure continues, and bateriasencasa.com shall be granted an extension of the period for performing them equal to the duration of the cause of force majeure. bateriasencasa.com will make all reasonable efforts to find a solution enabling it to fulfil its obligations despite the cause of force majeure.

10. WRITTEN COMMUNICATIONS AND NOTICES

By using this Website, the User agrees that most communications with bateriasencasa.com will be electronic (email or notices published on the Website).

For contractual purposes, the User consents to the use of this electronic means of communication and acknowledges that all contracts, notices, information and other communications sent electronically by bateriasencasa.com satisfy the legal requirement of being in writing. This condition shall not affect the rights granted to the User by law.

The User may send notices to and/or communicate with bateriasencasa.com using the contact details provided in these Conditions and, where applicable, through the contact areas of the Website.

Likewise, unless otherwise stipulated, bateriasencasa.com may contact and/or notify the User at their email address or at the postal address provided.

11. WAIVER

No waiver by bateriasencasa.com of a specific right or legal action, nor any failure by bateriasencasa.com to require strict performance by the User of any of their obligations, shall constitute a waiver of other rights or actions arising from a contract or from the Conditions, nor shall it release the User from the performance of their obligations.

No waiver by bateriasencasa.com of any of these Conditions or of the rights or actions arising from a contract shall take effect unless it is expressly stated to be a waiver and is formalised and communicated to the User in writing.

12. INVALIDITY

If any of these Conditions are declared null and void by a final decision issued by a competent authority, the remaining clauses shall remain in force and shall not be affected by such declaration of invalidity.

13. ENTIRE AGREEMENT

These Conditions and any document expressly referred to herein constitute the entire agreement between the User and bateriasencasa.com in relation to the subject matter of the sale and supersede any other prior covenant, agreement or promise made verbally or in writing between the same parties.

The User and bateriasencasa.com acknowledge that they have agreed to conclude a contract without having relied on any statement or promise made by the other party, except as expressly mentioned in these Conditions.

14. DATA PROTECTION

Any information or personal data that the User provides to bateriasencasa.com in the course of a transaction on the Website will be processed in accordance with the Privacy or Data Protection Policy (contained, where applicable, in the Legal Notice and General Conditions of Use). By accessing, browsing and/or using the Website, the User consents to the processing of such information and data and declares that all the information or data they provide is truthful.

15. APPLICABLE LAW AND JURISDICTION

Access to, browsing and/or use of this Website and contracts for the purchase of products through it shall be governed by Spanish law.

Any dispute, problem or disagreement arising out of or relating to access to, browsing and/or use of the Website, or to the interpretation and performance of these Conditions, or to the contracts of sale between bateriasencasa.com and the User, shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.

16. COMPLAINTS AND CLAIMS

The User may send bateriasencasa.com their complaints, claims or any other comments they wish to make using the contact details provided at the beginning of these Conditions (General Information).

In addition, bateriasencasa.com has official complaint forms (hojas de reclamación) available to consumers and users, which they may request from bateriasencasa.com at any time using the contact details provided at the beginning of these Conditions (General Information).

The European online dispute resolution platform ceased to operate on 20 July 2025 and is no longer available as a complaints channel. In the event of a consumer dispute you may turn to an alternative dispute resolution body approved in your country of residence. For cross-border purchases within the European Union, the European Consumer Centres Network provides free assistance.
